DISCLOSURE OF PROTECTED HEALTH INFORMATION ACKNOWLEDGEMENT OF RECEIPT OF NOTICE OF PRIVACY PRACTICES

Shane Holland, DO, PLLC DBA Holland Health: A Functional Medicine Clinic (AKA Holland Health) (“us”, “we”, or “our”) operates the https://holland-health.com website and any mobile or electronic application (hereinafter referred to as the “Service”) duly organized under the laws of Arkansas. This page informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Privacy. Holland Health collects, uses, and discloses certain personal information of members in accordance with their Privacy Policies, which are available free of charge upon request. Holland Health may contact you from time to time by telephone, email, mail. text message, or other means with information and offers related to your membership, services, or treatments which may be of interest to you. If you do not wish to receive such messages, you can opt out at any time.

HIPAA. The Department of Health and Human Services has established a “Privacy Rule” to help ensure that personal information is protected for privacy.  The Privacy Rule was also created in order to provide a standard for certain health care providers to obtain their patients’ consent for uses and disclosures of health information about the patient to carry out treatment, payment, or health care operations.

As our patient we want you to know that we respect the privacy of your personal medical care and will do all we can to secure and protect that privacy.  We strive to always take reasonable precautions to protect your privacy.  When it is appropriate and necessary, we provide the minimum necessary information to only those we feel are in need of your health care information and information about treatment, payment or health care operations, in order to provide health care that is in your best interest.

We also want you to know that we support your full access to your personal medical records.  We may have indirect treatment relationships with you (such as laboratories that only interact with physicians, not patients), and may have to disclose personal health information for purposes of treatment, payment, or health care operations.  These entities are most often not required to obtain patient consent.

Consent for Holland Health: A Functional Medicine Clinic (AKA Holland Health) to use and disclose protected health information (PHI) about you is used to carry out treatment, payment and health care operations (TPO).  (The Notice of Privacy Practices provided by Holland Health describes such uses and disclosures more completely.) 

The Notice of Privacy Practices is available prior to signing consent for treatment, membership, or services.  Holland Health reserves the right to revise its Notice of Privacy Practices at any time. A revised Notice of Privacy Practices may be obtained by forwarding a written request to Holland Health, Attn: Privacy Officer, 5208 W Village Pkwy Ste 1, Rogers, AR 72758.

With this consent, Holland Health may call, text, or email my home or other alternative location and leave a message on voicemail or in person in reference to any items that assist the practice in carrying out TPO, such as appointment reminders, insurance items and any calls pertaining to my clinical care, including laboratory test results, among others. 

With this consent, Holland Health may mail to my home or other alternative location any items that assist the practice in carrying out TPO, such as appointment reminder cards and patient statements as long as they are marked “Personal and Confidential.” 

With this consent, Holland Health may email to my home or other alternative location any items that assist the practice in carrying out TPO, such as appointment reminder cards and patient statements. I have the right to request that Holland Health restrict how it uses or discloses my PHI to carry out TPO. The practice is not required to agree to my requested restrictions, but if it does, it is bound by this agreement. 

Consenting allows Holland Health to use and disclose my PHI to carry out TPO. 

I may revoke my consent in writing except to the extent that the practice has already made disclosures in reliance upon my prior consent. If I do not sign this consent, or later revoke it, Holland Health may decline to provide treatment to me.

Collection of Information. We collect information you provide to us through the website and offline, for example when you create or modify your account, register to use our website, purchase products or services from us, request information from us, contact customer support, fill out any form on the website, or otherwise communicate with us. If you are a patient, or a person seeking information on Holland Health and its services this information may include:

Address

Email address

Telephone number

Payment information (credit card or debit card number, expiration date and credit card security code – solely for payment purposes)

Date of birth

Username and password

Any other information requested or provided through a contact form, email, text or other message with the website.

Definitions:

Service. Service means any treatments, membership, services offered through Holland Health in-clinic or on the website https://holland-health.com, including any mobile or electronic record software used for processing. 

Personal Data Personal Data means data about a living individual who can be identified from that data (or from those and other information either in our possession or likely to come into our possession).

Usage Data. Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Cookies Cookies are small files stored on your device (computer or mobile device) which are embed within the website, and that may be transferred to your browser or device to allow us or the third-party service to recognize your browser or device and tell us or the third-party service how and when pages and features in our Services are visited and by how many people.     • Holland Health uses a variety of software platforms to send you opt-in information about our services, specials, appointments, and customer support.

Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

You must be eighteen (18) years of age or older to order from this Website. Our Service does not address anyone under the age of 18 (“Children”).
